
The Supreme Court adjourned the request of the Prosecution for returning
to prison the Turkish citizen Abduselam Turgut, the address of which
remains unknown, after he was left in house arrest by the Court of
Appeals.
The process for assessing the custody measures was postponed again, after the absence of the defending lawyer. The Turkish citizen Abduselam Turgut was arrested in Albania for trafficking one ton of heroine in Germany. While the Court of First Degree left him in prison until the finalization of the extradition procedure to Germany, the Court of Appeals suddenly changed this measure to house arrest, while the Turkish citizen had no house in Albania. According to the Court of Appeals, the Prosecution had not presented the necessary evidence, although the Prosecution declared that had filed all documents that verified the act for which the Turkish citizen was accused in Germany.
The Court also assessed that the arrest order was sent by e-mail and no through a legal way, and another mitigating circumstance, considered as such by the Court, was the health condition of the Turkish citizen.
While asking to wait trial in house arrest, Abduselam had declared that he lived in a house that was located at “Kthesa e Kamzes” area in Tirana, without any other detail of the address. After this decision, the Turkish citizen disappeared and none of the apartments at that area resulted as his property.
Although the High Council of Justice declared that it had started the investigation, right after Top-Channel made public the scandal, there has been no result of these investigations so far. All that remains to be done is to wait this autumn, when the Court of Appeals will review the request of the Prosecution against the fact that no one lives in the address given by Abduselam Turgut. The Turkish drug trafficker most probably has left Albania, but this has not been admitted by anyone.
