Legal stalemate for appointing of next Prosecutor General

The Chairman of the Commission of Laws, Ulsi Manja, says that the term of the current Prosecutor General ends in December 7th, 2017.

The Constitution foresees that the ending of the term for the Prosecutor General is decided by the Supreme Council of the Prosecution, but this institution has not been created yet for lack of candidates.

In these conditions, Socialists say that the mandate is decided by the General Secretary of Parliament and the Monitoring Service of Institutions.

Oerd Bylykbashi, from the Democratic Party, has another opinion:

“Sane as they did with the High Council of the Judiciary, they should take representatives of the civilian society to complete the High Council of Prosecution”, Bylykbashi said.

In this position, the majority supports the opinion of Euralius and Opdat, missions from the EU and USA, who don’t exclude the option of having the new Prosecutor appointed by simple parliamentary majority.

Bylykbashi is categorical, addressing to the Constitution: “The decision is taken in parliament with 3/5th of the votes. We must also keep in mind that no candidate has passed the vetting, which is a basic requirement. The majority demanded to appoint him with 36 votes in Parliament, including the vote of Saimir Tahiri”, Bylykbashi said
