Kosovo, unconstitutional President

Kosovo Constitution has been infringed even with the Presidential election of Behgjet Pacolli. Constitutional Court of Kosovo concluded that February 22nd parliamentary session was unconstitutional.

“This election is against Constitutional article no. 86 provisions and the democratic principles represented on the Constitution of Kosovo”, Court’s decision says.

Article no. 86 states on clause no. 4 that on presidential voting, two thirds of Kosovo’s Parliament must be present on the floor.

This clause was the strongest argument that opposition parties used to oppose Pacolli’s election.

Democratic League of Kosovo deputy, Vjollca Osmani, declared on a phone conversation with Top-Channel that the biggest opposition party is waiting the official Court verdict, expected this Wednesday.

February 22nd parliamentary session that elected Pacolli as President had only 66 deputies on the floor after opposition’s boycott.

However, Pacolli found it very difficult to get the 62 votes even inside the majority, number achieved only after many interruptions called by Prime Minister Thaçi and pressure coming from American Ambassador Christopher Dell.

According to lawyer Mazllum Baraliu, this verdict was to be expected by the Constitutional Court, because it is obvious that quorum absence is against the Constitution.
    
What remain to be seen are the measures that Kosovo Parliament will take after Constitutional Court publicly announces the verdict, this Wednesday.
