Kosovo Constitutional Court rejects Mustafa

The Kosovo Constitutional Court has ruled that the appointing of Isa
Mustafa as Parliament Speaker on July 17th was anticonstitutional.

The Court has ruled that the procedure followed by the Kosovo Parliament after the suspension of the constitutive session led by Flora Brovina is against the Constitution due to the absence of a quorum.

The Court says that the MPs violated Article 67.2 and 64.1 of the Constitution, and Chapter III of the Parliament’s Regulation.

Due to these violations, the Court has found out that the Parliament’s decision for appointing Isa Mustafa as Parliament Speaker is against the Constitution.

The Court explains that it wasn’t the biggest parliamentary group the one proposing the Parliament Speaker, hence, the voting is invalid.

The Court has ruled that the biggest Parliamentary Group in Parliament is that of the PDK. The Constitutional Court has found that the constitutive session of the Parliament is not complete, because the chairman and the vice chairmen of the Parliament have not been elected.

For this reason, the Constitutional Court asked the Parliament to complete the session by choosing the representatives of these posts in full accordance with the Constitution and the Regulation.
