The Kosovo Constitution amendments, besides the approval of the Kosovo
Parliament, according to the Constitution, can be also returned for
review by the Chief of International Civil Office, as supervisor of the
Kosovo independence.
The Kosovo Parliament approved that the Commission for the Constitution amendment should work only on the way the president is elected, but new information indicates that this commission will not work only on this case.
The aim is that the Kosovo institutions should receive the executive competencies from the International Civil Office, currently directed by Peter Faith and the European mission of EULEX.
But will the amendment receive the green light by the International Civil Office? If not, what happens?
“The Constitution says that the Ahtisari plan is above all institutions, and this is a unique disposition. Disposition 147 provided that the last word belongs to the ICO representative. These dispositions limit the full independence of our institutions and of our country”, declared prof.Mazllum Baraliu, expert of the Constitution.
Prof. Baraliu expressed his optimism that the abovementioned amendments will be accepted, and, according to him, time has come for this to happen.
“The Ahtisari Plan provides that the first three years should be a proof, for seeing how his plan would be implemented. And this has gone well. I think that the Kosovo Institutions can handle these responsibilities”, Baraliu underlined.
Kosovo declared independence on February 2008, after a round of negotiations led by Marti Ahtisari, right after Kosovo accepted his proposition for a supervised independence for three years.
