competence to trial the 53 defendants accused for one ton of hemp that
was found in the Shkrel village, Shkoder.
This means that the sensational case of 2005 will continue to pass from one court to another, this time at the Supreme Court, which will have to decide which court will judge the Shkreli farmers who were accused of cultivating narcotic plants.
Last year, the Shkoder Court refused to keep the case for the same reasons. The Court of Serious Crimes announced the lack of competences after a new accusation was made for the 53 Shkreli residents. They were accused of participating in criminal structures, a charge that was strongly objected by the defense, which asked new investigations for this accusation.
The Shkreli case has turned into a challenge for the prosecution, after a series of tests made to the plants, initially in Tirana and then in England.
According to the accusation, the chemical tests show that the quantity that was blocked by the police has a THC percentage that is above the allowed limits, and it can be considered as Cannabis Sativa, but the defense has presented other tests made in Italy which show that the plants are within the allowed limits, which makes it industrial hemp. This result was also supported by the scientific forensic examination.
