Judge Shkelqim Mustafa gave the security measure with an appearance obligation for the National Guard Soldier Sadik Cela, who is being
investigated after the Prosecution pressed charges against him for the January 21st events, in which four protesters were killed.
The security measure was given at the Military Hospital and not in court, since the defendant was in bad health conditions after a surgery, and it was impossible for him to appear in the courtroom. The court decision said that the arrest measure was changed, since the prosecution failed to verify that one of the bullets that took the protesters’ life has come out of the National Guard officer’s gun, and the prosecution must bring new proofs until the investigation will end.
Sadik Cela was initially arrested after the January 21st events, and he was left in prison by the Court of Tirana. But the Court of Appeal freed him, arguing for insufficient proofs. After four months, the Supreme Court returned the defendant to prison for the 10 remaining days of the sentence.
The defendant did not serve the 10 days, because the Court decision was delayed and he remained free, obliging the Prosecution to repeat the request at the Court of First Degree for returning him to prison.
