After the replacement two of the judges that were working with the
January 21st case at the Court of Appeal, the Prosecution requested that
the rapporteur Astrit Haxhialushi should also be removed.
In today’s session, after consuming two similar requests by the lawyer of General Ndrea Prendi, it was the Prosecution’s turn to make the same request. One of the rapporteurs demanded Haxhialushi’s removal, arguing that he had been part of the two security measures that were given against two demonstrators, which, according to the Prosecution, violates the rules for an impartial trial.
This request made the court to withdraw without appointing a date, since they have to review bthis request first. Two former members of the judge panel, Fatos Qato and Agron Papajani were replaced by two young judges, Evgjeni Sinoimeri and Ervin Metalla. But if the resignation of the rapporteur is accepted based on the former decision, the Court of Appeal could be having fewer judges in this case, since all of themhave reviewed the measures of the demonstrators that were arrested during or after January 21st.
In this case, the only hope will be the seven new judges appointed recently by the High Council of Justice, some of them coming from the First Instance, but even some of them have given security measures for January 21st, such as Ritvan Hado, Fatmira Hajdari, Shkelqim Mustafa and Agim Bendo.
The only one remaining is Marie Qiriazi, which means that the trial of the three defendants will continue in Autumn.
