Ziver Veizi was one of the four demonstrators who were shot dead during
the protest of January 21st, 2011. His relatives filed a request at the
European Court of Human Rights in 2012. Four years later, this Court has
asked the Albanian government to give information about the criminal
file and hand over a copy of the case.
The Court of Strasbourg has also raised three questions which the Albanian side must answer, such as: “Have the applicants exhausted all internal options, as requested by article 35 of the Convent?
Have there been violations of the applicants’ rights for articles 2 and 13 of the convent? Have the authorities carried out an effective investigation for the death of the relatives of applicants, as requested by article no.2 of the Convent? Were the applicants allowed to be included in the investigation?
And thirdly, were the applicants’ rights violated for their court access, regarding the verdict of the Court of Tirana dated June 6th, 2012, when their civil lawsuit was rejected since they could not pay the full trial fee.
The daughter of Ziver Veizi, Ana Veizi, complained they were not allowed to be part of the triala nd investigation, and that the Albanian court did not hear their claims because they were unable to pay the high fee.
But the trial against the January 21st defendants has been suspended since October 2013 at the Supreme Court. The final verdict of this court is a main condition for starting the judiciary process at the European Court of Human Rights.
