One of the lawyers for the “Jon Complex”, and also resident in this
apartment building, Erinda Ballanca, insists that any conflict for the
issue of this building in Vlore can be resolved only in court.
“There is no invalidity, but even if there is, it is not judged by the state. Not by Manjani or the National Inspectorate of Urban Construction. This is only up to the court”, Ballanca declared.
For the lawyer, the permit has been given on an existing property, not at sea.
“Why Mr.Manjani claims that it doesn’t exist, when I have a document from this state that it exists? All facts on real estates are registered publicly. The owners were the Ndini family, who sold it to the current owners, who bought it and earned the property title”, Ballanca says.
For the lawyer, no court verdict or state document can be tried as long as the legal owners have not exhausted all legal means as foreseen by the law. Ballanca says that the Vlore National Inspectorate of Urban Construction has made all respective verifications.
“When the permit was given, there have been photographs and verifications. We have other documents and a letter from National Inspectorate of Urban Construction, which is an independent institution that supervises the municipality’s permits. We have the verifications for the construction works, and that proves that they have verified where the construction would be done. It’s not on the sea, it’s not on the air. The decision has been taken by the National Inspectorate of Urban Construction director, now chief of the Vlore Police”, Ballanca added.
The lawyer adds that if the verdict of the Administrative Court will be violated, there would be a criminal act in the making, a violation of the property ownership right.
