In a meeting held behind closed doors, the High Council of Justice took
the decision to remove the immunity and suspend Judge Neritan Tabaku for
intentionally suspending the explanatory arguments of the verdict that
found Ilir Xhakja innocent, who then killed the Chief of the Shijak
Police, Adem Tahiraj.
The decision was taken by request of the Prosecution, which is investigating Tabaku over power abuse. The lifting of the immunity for Judge Tabaku will open way to further investigations by the Task Force which was unable to summon the Judge due to the immunity.
On September 13th, Xhakja shot and killed the Chief of the Shijak Police, and being unable to escape, he turned himself in the next day.
The investigators saw Xhakja’s precedents. He was accused of murder, threats and traffic since 1994.
Xhakja was found guilty by the Court of Serious Crimes and was sentenced to 21 years in prison for the murder of Qerim Maloku. This verdict was left in effect by the Court of Appeal and was broken in 2009 by the Penal College of the Supreme Court, with the argument that the charges were not a competence of the Serious Crimes, but of the District Court.
After reviewing the case at the Durres Court of First Degree, Judge Neritan Tabaku has suspended the other charges by leaving only that of illegal arm possession, a time that Xhakja had already served while waiting for the trial. This brought the immediate liberation. These explanatory arguments were never published and the delay prevented the Prosecution from appealing the case.
HCJ took another decision against another judge, after discovering that she appointed fictive trials when she was abroad, in order to cover up her absence.
