Constitutionalist Clirim Gjata said that the situation created between
the President and the Government for the decree of two Ministers has no
legal stalemate, as long as the president is within the legal deadlines.
But the situation change if the deadline expires.
“If the President does not decree them after seven days, he has violated the Constitution. We cannot say if this violation is enough to discharge him. It is up to the Constitutional Court”, Gjata said.
The renowned Constitutionalist added that the state law needs amends as regards the formula for the vote of confidence of Ministers.
“The Parliament gives confidence to the Prime Minister for his program and government once in four years, not for every specific Minister. There is no country in Europe that needs to vote the presidential decrees. This needs to be regulated with the new Constitutional draft”, Gjata said.
