“Gerdeci”, Prosecution: Court was wrong

20 days after the First Degree Court verdict for the 29 Gerdeci tragedy
defendants, as it happens with all cases when the court delays the
verdict’s explanatory argumentation, the prosecution appealed the case
without arguments, reserving the right to give the concrete objections
after receiving the verdict.

Top Channel has secured a copy of the appeal document which says: “We notify that we are filing this appeal in absence of an explanatory verdict, which makes it impossible for us to give our arguments about where the court has been wrong. We will bring the arguments in a second moment, after we will get acquainted with the Appeal verdict for the Gerdeci case, a right granted from article 415/2 of the Penal Code”.

By emphasizing that there is no detailed and objective analysis of the evidence reviewed during the process, the prosecutors continue:  

“This verdict is a wrong interpretation of the penal and procedural law. This verdict is a result of a wrong interpretation of the penal act as provided by article 79.DH and 79.Ë of the Penal Code, and Articles 70/2 of the Military Penal Code”.

While waiting for the explanatory arguments, the prosecutors keep the same stances for the charges and sentencing of the defendants as they declared at the First Degree Court, insisting that the Tirana Court verdict must change by adding three life-to-prison sentences and by changing the decision for finding 10 of the defendants not guilty.

The defending lawyers have also made their appeal by simply emphasizing the innocence of their clients and by reserving the right for holding a concrete stance after the court verdict explanation.
