On January 1st entered in effect the law amends for the free Legal
Assistance for every citizen who has no financial possibilities, and who
can address to the state for a lawyer in criminal, civil or
administrative trials. These people will also be excluded from the
judiciary tax and court spending.
People who have no financial means for legal defense may address to the Ministry of Defense for legal help, and complete a form.
“This initiative helps people who cannot afford paying the court fees. The only duty of citizens is to present the application at the Commission of Legal Assistance at the Ministry of Justice, and then the Commission decides”, declared Blegina Agolli, Chairwoman of the State Commission for Legal Help.
While the progress report of the European Commission suggests to increase transparency, efficiency and credibility for the legal assistance by improving the right to access to justice, the Head of this Commission sees the inclusion of the Ministry of Social Welfare and Youth as a necessity, as part of this group.
“The only difference that the Commission is dealing with for the moment is that the member of the commission, within the legal limits, should be a representative of the Ministry. The staff of this ministry deals directly with this category that apply at the Commission. It is a necessity for the representatives of this ministry, due to their work”, Agolli declared.
171 citizens addressed to the State Commission during 2013, mainly for divorce and administrative cases, while 39 are criminal cases.
