Difference between SP and DP drafts

Two projects will be reviewed by the Parliament for the law that lifts
immunity from high rank officials, one from the Socialist Party and one
from the ruling Democratic Party. The one offered from the Socialist
Movement for Integration, part of the governing coalition, was
disqualified due to the lack of 28 signatures.

The Democrats have adapted in the Albanian language the draft of EURALIUS, the office for assistance in justice by the European Union for Albania and PACA, the anti-corruption project of the Council of Europe for Albania, which provides a full removal of the immunities for MPs and Ministers.

This means that they can be prosecuted, arrested and have their residences inspected by the authorities for every criminal act, besides the Parliamentary vote.

The draft of the Socialists doesn’t demand the full removal of immunity, but keeps intact that of MPs or Ministers at least for being arrested and for having the residences inspected by the authorities. According to the Socialist Fatmir Xhafaj, who presented the project, this defends the MPs from eventual political attacks.

 “Our amend is for the task of the MP, but above all for the functionality of the Parliament by keeping in consideration the standards applied in other European countries, and the situation of our country. For this it is necessary to have guarantees from the procedural actions that could be encouraged by selective and electoral actions, based on the internal political battle. These procedural guarantees would help the opposition to exert its duties normally”, Xhafaj declared.

The EURALIUS project provides these guarantees with a Parliament decision, which can return the immunity to the MPs when they find it appropriate.

After the hearing session, MPs Edi Paloka and Pandeli Majko will cooperate for presenting a common variant. But only after a few days we will see if the Democrats and the MPs will find consensus for the immunity.
