
The Supreme Court decided to return to prison one of the National Guard
vice officers, Sadik Cela, accused by the Prosecution for the January
21st events.
Cela was set free some months ago by the Court of Appeal, due to the lack of proofs.
The Supreme Court gave this decision this midday, while official sources of Prison 313 declared for Top-Channel that the defendant had not been handed over to prison authorities, leaving in mystery the fact that although many hours had passed, the National Guard officer, Sadik Cela, did not return to prison.
The General Prosecution confirmed for Top Channel that is still waiting the disposition of the Supreme Court for ordering its execution, which means returning Mr. Cela to prison.
While it is known that the Supreme Court – referring to the decisions that have been ruled in other occasions when the accused have returned in prison – proceeds by handing the disposition to the prosecutor that represents the Prosecution Office, without spending time until the argumentation of the decision is released.
The National Guard officer, Sadik Cela, was arrested after the murder of four protesters in front of the Prime Minister’s office, on January 21st, together with Gazmend Ahmetaj and Mark Nikolli. Afterwards, the Court of Tirana gave the security measure of 30 days in prison, until the prosecution would hand over the other proofs.
The defendants stayed in prisons for 20 days, and after this the Appeal released them, what obliged the Prosecution to complain at the Supreme Court.
The Prosecution was expecting this decision this summer, while after being sent to the custody measure cells, Sadik Cela will have only 10 days to serve. The Prosecution will have to find new proofs for turning him to prison again.
Currently in prison is only the National Guard officer Agim Llupo, accused of having killed the protester Ziver Veizi.
