The Court of Appeal rejected the request of Agim Llupo for being
released from prison. After staying in prison for one year, waiting for
his file to be sent at court, the National Guard Officer had his case
postponed by the Court, after a request made by the Prosecution.

Although Llupo has stayed for more than one year in prison, his charges have not been formalized yet. He is still under investigation, and not as defendant.

On February 8th, the investigation deadline ended, and the Prosecutors should had sent his case to court.

“The interrogation of the person that is being held in prison is a necessity, because here starts the clarification of the procedural situation. There’s no obligation to interrogate him in a given time, but he cannot be left one year without this procedure”, declared his lawyer, Fatos Shanaj.

But judge Shkelqim Mustafa rejected this request, because he had already accepted the Prosecution’s request for extending the investigation period.

Llupo will address to the Appeal for both decisions.
