Court flooded by delayed cases

Once again, the President of the Supreme Court, Shpresa Becaj, raised
the alarm bells for the high number of delayed cases that have not been
reviewed by the penal and civil colleges, a concern raised by her two
years ago.

“The supreme court is very busy with a considerable number of civil and penal cases that have been delayed year after year. We are waiting for them to be reviewed according the law. For illustrating this alarming situation, we announce that by the end of 2011, the number of cases that have been delayed from the former years has been 9198, almost 3.5 times more than the average in this court. This situation has been caused by a series of factors that have negatively affected the work. The structure of the Supreme Court judge panel is composed of 17 members and its organization with two colleges, the civil and the penal one, according to the law, makes it impossible to treat all these cases. Secondly, the failure to fill the two vacant places at the Supreme Court makes it even more difficult”, Becaj declared.

But besides the propositions in the Draft-Law for the Organization and Functionality of the Supreme Court, which says that the Supreme Court will have 17-19 members, President Shpresa Becaj says that this number must go to 23.

“This makes evident the change of the respective dispositions in the law of the number of judges at the Supreme Court, making 23 members from 17, and adding the colleges by creating the Administrative College at the Supreme Court and the review of the number of members in these colleges, according to the significance of the cases, respectively with 3, 5 or 7 judges”, Becaj declared.

During the conference for the Supreme Court reforms was presented the draft law “for the organization and functionality of the Supreme Court”, where the changes of article 3 can be noted, about the conditions and criteria for the election of judges. There are some amends that do not allow judges who have been members of political parties, who must have no disciplinary notes, no conflict of interests or family relations, etc.
