Court blocked the appeal for Xhake’s case

After the murder of Chief of Police Tahiraj, the main suspect of which is Ilir Xhakja, other shocking facts are coming to light.

He was released as innocent by the Court of First Degree in Durres, by Judge Neritan Tabaku. These arguments for this decision have not been published yet, although all legal deadlines have expired.

For this reason, the Court of Appeal has not started reviewing the case. Top Channel has received the request of the Prosecution during Ilir Xhake’s trial. The Prosecution had demanded 25 years of prison for intentional murder in cooperation and arm possession.

The fact that the arguments of this decision have not been given since February 2011 has been officially confirmed by the General Prosecution. The adviser for the media at the Prosecution declared that the case against Ilir Xhake has been tried by the Court of Durres and the prosecutor has demanded 25 years of prison.

After the decision, the Durres Prosecution has appealed the decision on August 18th and we are still waiting for the Court of Appeal decision. Adviser Nesturi says that the appeal was filed without having the arguments of the verdict.

According to the documents received by Top Channel, Xhakja was sentenced to 21 years in prison for the murder of Qerim Maloku. The decision was left in power also by the Court of Appeal and in 2009 was rejected by the Penal College of the Supreme Court, with the argument that this accusation was not a competence of the Serious Crime, but of the District Court.

After the case was reviewed at the First Degree Court in Durres, by Judge Neritan Tabaku, he has suspended the other accusations by leaving only the arm possession, giving him the immediate release.
