Constitutional Court rejects President

The Constitutional Court decided to reject the request of President
Bamir Topi for a final interpretation of the conflict between the
President and the Parliament for appointing the Constitutional Court
members.

Sources from inside the meeting say for Top Channel that the decision was not unanimous, but, however, it was not with a narrow difference in votes.

Six of the members voted against Bamir Topi’s request, while three others voted in favor.

The conflict between the two institutions was born a few months ago, when the Parliament approved only one of the four Presidential candidates for the Constitutional Court.

After an earlier decision of the Constitutional Court for the rotation of its members, the Parliament majority declared that this institution had only one free seat, and not four, as the President had declared.

For this reason, the Parliament returned three decrees of the Presidency, what was interpreted by Topi as an anti-constitutional act that damaged the principle of independent powers.

The explanatory arguments for this rejection was not made public by the Constitutional Court.
