The Constitutional Court of Kosovo published the explanatory arguments
for the decision they took a few days ago, about who is entitled to
create the new government. The request was made by the President of
Kosovo, after the opposition parties, LDK, AAK, Initiative and
Self-Determination Movement created a coalition to appoint Ramush
Haradinaj as Prime Minister.
The Court explained that the coalition with the highest votes can propose to the President the next Prime Minister of the country, when the coalition is formed based on the rules. The Court says that the President doesn’t have the right to reject the candidate proposed by the winning coalition, but may accept the changing of a candidate by this coalition.
Said more simply, President Jahjaga has to approve Hashim Thaci for the new government, but his party needs an ally to form the majority. Since the opposition parties refused this option, the next candidate can be proposed for Prime Minister, who in this case is Ramush Haradinaj.
The incumbent Prime Minister, Hashim Thaci, greeted the Constitutional Court’s decision on Facebook and said that he fully respects it. The AAK, whose leader, Ramush Haradinaj, is proposed for the opposition coalition, is convinced that this decision allows the opposition’s coalition to create the new government.
The US Embassy in Prishtina appealed all Kosovo leaders to respect the verdict of the Constitutional Court, saying that the ability of the Kosovo institutions to manage this process will honor the democratic development of Kosovo.
