CEC Chairman election

They will choose four names from a list with 18 candidates, who will
continue with the hearing session procedures of the hearing session at
the Commission of Laws.

Each MP of this commission has received a form with the four names that are to be elected. After verifying them in the system, the applicants that have the biggest support from the Commission members will be appealed in the hearing session.

After this procedure, the Commission will give its support for two members, the names of whom will be sent at the Parliament and whoever secures a simple majority voting will be elected chairman.

This is the procedure that according to the majority should be followed, since it is not necessary to hear the 18 applicants when it is not obligatory from the Electoral Code.

This procedure has been opposed by the Socialists, as mentioned yesterday in the incident between Damian Gjiknuri and Ilir Rusmali.

The Socialists say that the hearing session needs all candidates, according to the law. SP refers to article 15.3 of the Electoral Code, which says that:

“The list of candidates goes to the Parliament’s Commission that covers the legal issues for verifying the fulfillment of the criteria. The Commission reviews the candidacies according to the Parliamentary Regulation”.

Article 111.7 provides: “For the election of the constitutional organisms or that are created by law, the Commission for the legal matters reviews the fulfillment of the constitutional and legal criteria, and the merit of every candidacy. The Commission organizes public hearing sessions with each candidate”.

The Socialists refer exactly to this article of the regulation when they support this procedure for the CEC Chairman. Contacted by Top Channel, the opposition representatives at the Commission of Laws declared that they will support the law implementation in a hearing session with all applicants.

The parties have added another point, voting the Chairman and the CEC members on the same parliamentary session.

Referring to article 15.1 of the Electoral Code, according to which the seventh member of CEC and Chairman is elected not later than 10 days after the procedure is over, the Socialists say that the voting should be according the legal deadline, after the election of the members.

In these conditions of deep differences for the CEC members, it is not sure what the solution will be.
