Bring evidence for reports

Fraudulent sale of apartments, with citizens buying the same object at
the same time, has been considered as a very serious concern for the
Albanian Prosecution.

General Prosecutor Adriatic Llalla said during his annual analyze the several citizens have reported in Tirana of being defrauded in the last year by this scheme. Citizens have paid considerable amounts of money for apartments not yet finished, but the same procedure has applied to others, making two or three people paying for the same object.

“For this problem, the Prosecution of Appeal says that if no legal solution will be taken, as judged by the Prosecutors at the Court of Appeal, there will be a constant challenge at the Supreme Court, in order to reach a unifying decision, because it would be a concerning problem mainly in the real estate market. This is a very concerning problem of the recent times”, Llalla declared.

Although the Prosecution has claimed that this is about the crime of fraud, the Court has found the defendant innocent in 60 cases, and has considered the preliminary agreements as civilian cases.

By analyzing the Prosecution’s analyze, Prosecutor Llalla declared that the investigation unit against corruption has concluding some investigations that have had public impact, but according to Lalla, there are others that need a higher investigative pace. Referring to the reports, Llalla added that most of them don’t have enough evidence, and that has been the main problem.

While the Prosecutor General underlined the request to the police to bring evidence with these cases, the Chief Judge at the Court of Appeal, Aladuin Malaj, was more demanding on this point.

The Chief Prosecutor of Appeal, Shkelqim Hajdari, suggested that for 2014 there will be changes at the Court of Penal Procedure as regards the trials in absence. He also said that the Institution of Summary Judgement. Hajdari declared that the session of advising at the Supreme Court should be open and with the presence of Prosecutors.

“There is still a wide distribution of property crimes, which are related with crimes against lives, illegal armed possession and corruption”, Hajdari declared.
