Bailiff blocks Ministries’ finances

If the crisis of the budget reduction and lack of funds in the state
budget weren’t enough, the government’s main institutions are facing
another phenomenon: private bailiff offices.

The public administration used to skip court decisions by delaying the execution, since they had a state owned bailiff office.

But with the law for liberalizing this service, enforcement of court orders is now offered by many private companies, licensed by the Ministry of Justice.

In these conditions, when the new rules are being implemented for more than one year, many ministries are facing a difficult financial situation, since the private bailiff office doesn’t tolerate skipping court orders.

“Shqip” newspapers learns through the Ministry of Finances that some departments have had financial problems, after the bailiff have blocked their “concrete expenses”, such as the costs for travels, per diem payments, working materials etc.

The law clearly states the rights and functions of a private bailiff office to intervene with the finances of any state owned institution.

The problematic situation is related with the trials that the court has lost for firing people and for disagreements with private companies.

There are hundreds of millions of ALL that have been blocked, and the Ministries are unable to unblock the budget, due to the rights that law gives to bailiff offices.

In these difficult conditions, Prime Minister Berisha, in cooperation with the Minister of Finances, planned a special order for requesting to pay the trial expenses with installments, avoiding in some way the financial hold-up.
