Alibeaj: The President and the Constitution

Enkelejd Alibeaj, the Democratic MP of the Commission of Law and former
Minister of Justice believes that the Constitution of 1998 failed with
the Presidential election formula. He says that the low election
standard has brought figures that were unable to calm political battles
down and have never spoken when they should.

“We have fallen prey to a presidential hybrid that has found the most comfortable way of closing inside his shell, maybe attacked from all sides 24/7. This is the history that I believe will bring the Constitutional amends”, Alibeaj declared for Top Channel. However, he categorically excluded any possibilities for amending the Constitution in this point.

“At least the Constitution part belonging to the President is not submitted to the nightmare if the Constitution will be amended or not, because this Constitution is already amended for this part. Most important is the kind of product that we will offer for the Parliamentary and Constitutional system in this case”, he added.

In some way, Alibeaj answers to this question by himself when he says that the existing formula will bring a political President.

“It is certain that the current formula will produce a President that will belong to the majority”.

After the Constitutional amends of April 21st, the election of the Albanian President in the fourth and fifth round will be made with simple majority of 71 votes. In the previous version, this formula could be used only if the Parliament would be dissolved for two consequent times, for not achieving a qualified majority of 84 votes. The current President and former President Mojsiu support the election of a President elected by the people.
