Aldo Bare case at Constitutional Court

Three days after the Supreme Court gave the explanatory arguments about their decision to return his case for review at the Appeals Court of Serious Crimes, his defensive lawyer made public the decision for sending the Bare case at the Constitutional Court.

According to lawyer Vladimir Meci, the Penal College decision has no reason to touch the violations based on which the Appeal of Serious Crimes returned  the life sentence due to the several violations.

“I will address to the Constitutional Court for repealing this decision, because the Supreme Court has violated article six of the European Convention, or Article 42 of the Constitution for a normal judicial process. Who has given the explanatory arguments of the verdict, who has given it and who has signed it. Naturally I don’t know if there are against or in favor. He must make the calculations with his professional conscience, but it is offensive for my colleagues and the entire community of judges”, Meci declared.

Meci declared that the double and controversial status given at the First Degree Court is one of the hardest violations against his client.

“I don’t understand why in these three months, this verdict has been delayed, when what the Court of Appeal has identified were not seen properly”, Meci declared.

Now that the Bare case returned to the Court of Appeal, the trial of this case will have two dilemmas. First, who will be the judges of the trial? Almost all of them have been consumed. Second, will the Court of Appeal revio0ew this case, while the lawyer is addressed to the Constitutional? What will happen with Bare’s pretrial detention deadlines, a concern that has often been raised by his lawyers?

“I will calculate all deadlines, and if needed, I will address the Court of First Degree”, Meci declared.
