Linda Rama: Between Family, Work and Albania’s Future The Socialist MP, Erjon Brace, declared that the privatization procedure
for Albpetrol has gone outside the legal limits and every government
decision is now illegal.

“Article 3.1 of chapter four, for the preparation of offers says that the bid will be valid for 120 days. The deadline has expired on January 7th. All other offers are outside the legal timeframe, and do not exist”, Brace declared.
The deadline can be prolonged only if the government has officially notified the second bidding company, according to Brace.
“All further steps recommended by the Council of Ministers are now consumed. The Ministry has violated the law with the negotiations and any other action, as foreseen by the Council of Ministers decision. This means that the process is dead”, Brace declared.
But according to the Socialist MP, this is not the only legal problem. The government has accepted that the 85 million EUR guarantee is problematic and failing with that raises other legal responsibilities that for Brace are clear evidence that the process should undergo a comprehensive investigation.
“It doesn’t need anyone to report it to the Prosecution, because the Prosecution itself must have the responsibility to start investigating for power abuse, especially for the Ministry of Economy, the Tender Commission, the consultant chosen by the government, Patton Boggs, and the company that was declared winner by the government. This should be investigated as soon as possible”, Brace declared.
The Socialist MP underlined that the Albpetrol sale is a dead process and the government must return it to the citizens through a public management.
