Eight articles of the draft law for the administrative courts were approved in the last meeting of the Parliamentary Commission of Laws, but the discussion were interrupted due to the different views of the parties on the other articles.

The rapporteur of this draft-law, the Socialist MP, Armando Subashi, explains two aspects of the problem, during the discussion.

“These moments were about whether we should include the administrative contracts in the competence of the Administrative Court or not. We think that they should be trialed by the Administrative Court, but the government thinks that they should continue to be a competence of the common courts. There were arguments from both parties and we found a common language. The second and most important principled moment was about providing a Special Administrative College at the Supreme Court. We are determined on this point, because we have not only legal and constitutional arguments, but also the support, since we reflect in the commission all suggestions coming from the interest groups, such as the associations of businesses, judges and lawyers”, Subashi declared.

MP Subashi says that the propositions of the opposition members in this commission are also compatible with the business suggestions, who saw the Administrative College at the Supreme Court as indispensable.

“I don’t think that ending the process as soon as possible is the most important part here, but to continue developing the process that we have started and making a qualitative law. It doesn’t matter if it will be concluded one week earlier or later, if the law doesn’t have the necessary quality and doesn’t reflect all objections and suggestions of all actors. This is what concerns us most, and we will be extremely careful until the end of this draft law”, Subashi declared.
