Albania’s lawyer for Bankers dispute: “Don’t pay $57 mln”

The lawyer who assisted the National Agency for Natural Resources in
their conflict with Bankers, advised the government to no accept the
expert decision to return 57 million USD of taxes to the Canadian
company, but rather challenge it at the Court of Arbitration.

Top Channel obtained the official letter that the American “Curtis” company sent to the AGNR. “We strongly recommend the expert panel to appeal the decision at the Court of Arbitration”, the letter says.

According to Bankers, them and the government have agreed that the expert decision of “Price Water House Cupers” and “Navigant” should be final. But lawyers have another opinion.

“If ‘Bankers’ was not happy with this decision, they would most certainly exerted their right to arbitration”, says the letter of the legal representative.

According to the lawyer, the right to appeal any decision is a normal and standard practice. “Curtis” thinks on this case that the reasons to take the case at the Court of Arbitration are very strong.

“The decision of the panel of experts is wrong, insufficient and unacceptable for many reasons”, he continued.

The lawyer says that the lack of an appeal from the government would be unusual and surprising.
