SP, legal battle, not over yet

Democratic Party legal representatives, Ivi Kaso and Oerd Bylykbashi
declared after the Electoral College rejected the Socialist Party appeal
that the opposition has no more legal spaces for opposing the result of
Tirana’s mayoral race.

But for the Socialist Party, the recent decision of the Electoral College is not the last one, as the Democrats claim, in this long legal battle from which the opposition said that there was no justice, but the theft of Tirana Municipality was just sealed.

During an interview for Top-Channel, SP Secretary for Legal Matters, Fatmir Xhafaj declared that the two-year old battle of the Socialist Party for the stolen vote of General Elections 2009 and May 8th Local Elections will continue.
Initially he commented on the latest developments at the Electoral College.

“Yesterday’s decision was just the certification of the theft that is being made to Tirana. In the most absurd way, the Electoral College argued that the request of the Socialist Party was made out of the legal deadline. We were leading with 10 votes ahead, and we could not make any appeal at the moment. After the result was announced, the Socialist Party had the right to ask the invalidity of these elections, and that is what we did”, Xhafaj declared.

Mr. Xhafaj accused the Electoral College of using double standards.

“Yesterday’s decision was contradictory to the Electoral College itself. In these same conditions, this very same Electoral College has taken the opposite decision in 2006 and 2009, but it was different in 2011. The Electoral College contradicted the decision that they took even one month ago for some communes”, Xhafaj declared.

The Socialist Party declared that now it is more important than ever to continue this battle until the end, and not only this:

“We will see the possibility of denouncing this process at the Albanian General Prosecution. Another step is the appeal at the Constitutional Court, the consultation with the Commission of Venice and the Court of Strasbourg. It is very important to follow the truth, because it has to do with the future of our country’s elections”, Xhafaj declared.
