Pacolli, Constitutional Court gives other clarifications

Constitutional Court has given additional clarifications regarding the decision that nullified the Presidential election procedure, ruled as unconstitutional.

In the decision that contains clarifications as response to the questions raised by the Parliament Speaker, the Prime Minister and Mr. Behgjet Pacolli, the Constitutional Courts notes that the decision that nullified the presidential mandates enters in effect on March 31st.

From this day, the decision says that Kosovo will have a president, but does not specify who.

Always according to these questions, the Court has clarified that Kosovo will not go on early elections. There is no need to dissolve the Parliament and the country is not in an institutional vacuum.

Meanwhile, for the question raised by the government if the presence of two thirds of the deputies is required on the Parliament floor during the first and second round of presidential elections, and if the third round can start without 80 deputies’ presence on the Parliament floor, the Court has replied:

“The Constitutional Court reminds that the purpose of this clarification is to clarify the decision that was taken, and this clarification has no authority to go beyond the object of the demand. Therefore, the hypothetical situations mentioned on the Prime Minister’s letter, are beyond the object of the demand and could be the base of a new case”, says the Constitutional Court clarification.
