Electoral College arguments: SP appeal, unfounded

Other details have come to light about the Electoral College decision
that rejected this Friday the appeal made by Socialist Party for ruling
as invalid the decision of the Electoral College for counting miscast
ballots.

“The pretenses of the plaintiff, the Socialist Party, are unfounded. The CEC decision regulated a disagreement that was created in the vote counting phase”, says the decision of the Electoral College.

The Electoral College justifies CEC, declaring that it has followed the law and has not surpassed its competences, as the Socialist Party pretends.

“CEC decision is based on the Code of Administrative Procedures. The CEC decision is not a normative act, which requires 5 votes, but individual. CEC has not surpassed its competences for miscast votes”, says the argument of the Electoral College.
