Electoral College: All ballot boxes to be reassessed

At the limit of the legal deadline, the Electoral College published the arguments that explain the decision taken on Monday June 13th. The Electoral College rejected some decisions taken by Central Election Commission, among which is decision 827.23. (Update)

Clauses 2 and 3 of CEC decision no.827 regard the refusal of this Commission to announce the result for Zonal Election Commission 49, at Municipality Unit 5.  Clause 3 is the decision that CEC took for not announcing the final result of the Tirana mayoral race. These clauses were objected by the Socialist Party and rejected by CEC.

The College gives its arguments for the other decision, the one of reassessing all miscast ballots. Despite the fact that these ballots were misplaced, according to the Electoral College, an equal count of all these ballots guarantees that the will of the electors will be fairly read.

Decision 711 that was taken by CEC for announcing the changed result for Tirana Municipality was consequence of actions that were taken against the law, because this decision did not show the result of Tirana.

Decision 710 and 711, taken by CEC on May 23rd, are against the law because in both cases, CEC has performed a procedure that changes the result of the summary tables through a decision that violates article 123 of the Election Code.

According to Electoral College, CEC has acted against the principle for equal reassessment of all ballots and for keeping a fair standard in this administrative investigation. Miscast ballots had been considered by electoral subjects as invalid until May 14th, but after this day they were considered as contested.

The Electoral College says that this proves the absence of commissioners’ notes in the protocols of all 11 Zonal Election Commissions of Tirana, regarding miscast ballots until May 14th.

The College states that the status of these ballots is not “contested”, because every political subject had agreed to consider them as “invalid” until May 14th.

For this reason, the Electoral College orders CEC to open, recount and reassess all contested ballots in all unopened boxes for 368 Tirana Voting Centers. The boxes to be opened are those for the Mayor of Tirana, for the Municipal Council, the Municipal Unit and Council of the Municipal Unit. The aim is to find miscast ballots, the total sum of which will be added to the general summary table.

As for the inconsistencies, the Electoral College says that this is due to the fact that CEC has counted only 117 ballot boxes.
