Court suspends case against doctor

Court of Tirana suspended the criminal case against Xhevahir Hoxhallari,
accused for the death of the 17 year old Matilda Petriti from Pogradec,
who lost her life after a tonsil removal operation in summer 2008.

The news of his arrest was followed by a lot of attention from the media, the Police and the Prosecution. However, Dr. Hoxhallari was defended with all means in trial. He has even obliged the prosecution to withdraw his file from the court, with the argument that it was going to be reviewed.

Sources from the Court of Tirana declared for “Shqip” newspaper that the suspension of this trial was recorded some days earlier. In the moment that the prosecution would announce its pretences, the prosecutor requested the Court to withdraw the acts based on article 377 of the Criminal Code, and suspending the withholding measures against Xhevahir Hoxhallari.

The pretenses of the defending lawyer have been that the defendant pleaded innocent. After discussing the case, the court decided: “To suspend the criminal case against Xhevahir Hoxhallari, accused of ‘Neglecting with his profession as a physician’, because the criminal court must not continue. The court expenses will be charged to the Tirana Prosecution.”
